Welcome to MacroMenu. These Terms of Service ("Terms") govern your use of the MacroMenu mobile application (the "App") operated by MacroMenu ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

MacroMenu is a mobile application that helps users find restaurant meals that align with their fitness and nutrition goals. The App provides:

• Personalized daily calorie and macro targets based on your profile
• Restaurant meal recommendations ranked by how well they match your goals
• Nutrition information for restaurant menu items
• Location-based restaurant discovery
• Meal optimization suggestions

2. Account Registration

To use certain features of the App, you may need to create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3. Subscriptions and Payments

MacroMenu offers subscription plans that provide access to premium features.

• Subscription Plans: We offer monthly and annual subscription options
• Free Trial: We may offer free trial periods. At the end of the trial, you will be charged unless you cancel
• Billing: Subscriptions are billed through your Apple App Store account
• Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Cancellation: You can manage and cancel subscriptions in your App Store account settings
• Refunds: Refund requests are handled by Apple according to their policies

4. Nutrition Information Disclaimer

IMPORTANT: The nutrition information provided in the App is for informational purposes only. While we strive to provide accurate information:

• Nutrition data may come from third-party sources and may not always be accurate or up-to-date
• Restaurant menu items and nutrition values may change without notice
• Actual nutrition values may vary based on preparation, portion sizes, and customizations
• Some nutrition values may be AI-estimated and should be treated as approximations

The App is not a substitute for professional medical or nutritional advice. Always consult with a healthcare provider or registered dietitian before making significant changes to your diet, especially if you have health conditions or allergies.

5. Allergen Warning

While the App attempts to identify meals that may contain your specified allergens, we cannot guarantee the accuracy of allergen information. Always:

• Verify allergen information directly with the restaurant before ordering
• Inform restaurant staff of your allergies when ordering
• Do not rely solely on the App for allergen avoidance

6. User Conduct

When using the App, you agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App or servers
• Reverse engineer, decompile, or disassemble the App
• Use automated means to access the App without our permission
• Impersonate any person or entity
• Collect personal information about other users

7. Intellectual Property

The App and its original content, features, and functionality are owned by MacroMenu and are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Use our trademarks or branding without permission
• Create derivative works based on the App

8. Third-Party Services

The App may contain links to third-party services or integrate with third-party services (such as restaurant ordering platforms). We are not responsible for:

• The content, accuracy, or practices of third-party services
• Any transactions you conduct with third parties
• Any damages arising from your use of third-party services

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OF NUTRITION INFORMATION
• UNINTERRUPTED OR ERROR-FREE SERVICE

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MACROMENU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or use
• Personal injury or health issues
• Allergic reactions
• Errors in nutrition information

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless MacroMenu and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

12. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, if:

• You breach these Terms
• We are required to do so by law
• We discontinue the App

Upon termination, your right to use the App will immediately cease. You may also delete your account at any time through the App's settings.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by:

• Posting the new Terms in the App
• Updating the "Last Updated" date
• Sending you a notification (for material changes)

Your continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If we cannot resolve the dispute informally, you agree that any legal action shall be brought in the courts located in the United States.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MacroMenu regarding the use of the App.
